General terms and conditions of the online shop lay down the conditions for the purchase and sale of products, carried out by the company Proneo d. o.o., Gorjančeva 11, 1000 Ljubljana (here in after: the provider). Online store coolkitchen.eu (hereinafter online store) is an information system designed for presentation and sale of products to users. It is managed by a company Proneo d.o.o. The user is a person who uses our system, so the buyer in the online shop coolkitchen.eu. General terms and conditions address the operation of an online shop, the rights of the user and the business relationship between the provider and the buyer.

You also understand that we cannot and do not guarantee or promise that any content on this online store will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the safety and reliability of data input and output.

Payment methods

No matter which method of payment you choose for your purchase you will receive an invoice your package. We currently accept the following methods of payment:

Credit cards - Visa, MasterCard, American Express, etc.
PayPal payments

Until full payment the products from each of the contract are owned by the service provider.

Prices

All prices are stated in EUR. The total cost of your order is the price of the products ordered plus delivery charges. Our prices are reviewed regularly and may change without prior notice at any time.

Shipping costs and delivery

Provider ships with DPD International. Shipping costs and estimated delivery time are listed below in table and depends on custumer country. When your order will be dispatched from our warehouse you will recieve a unique DPD tracking code, which provides you the ability to track your shipment from our warehouse to your door. Tracking code also provides you an estimated delivery date. We are not liable for any additional costs that may occur and are specific to your country.

Terms of sale

By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery page for further information.

In order to contract with CoolKitchen you must be over 18 years of age and possess a valid credit card issued by a bank acceptable to us or PayPal account. CoolKitchen retains the right to refuse any request made by you, and CoolKitchen reserves the right to close your CoolKitchen account at its sole discretion. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Websites may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.

Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved us and we have debited your credit card or PayPal account.

Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly where applicable and included in the 'Grand Total Incl. Tax'.

The Website may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the Website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

Promo Codes

From time to time, we may offer promo codes which may apply to any, or certain specified purchases made through the CoolKitchen Website.

Each Promo Code will be subject to specific terms & conditions specificed at the time the promo code is issued (including the length of time to use the code) in addition to those mentioned in these Terms of Use.

There are two ways of receiving a promo code:

We may send one to you via email for reasons such as, without limitation, your birthday, your CoolKitchen anniversary and student validation.
From time to time, we may offer promo codes on the CoolKitchen Website that you can apply at checkout in order to receive a specific discount from us.

Only one promo code can be used against an order at any one time.

A promo code can't be applied to an order after that order has been placed.

Certain brand or product category exclusions may apply so we’ll let you know if you can't use your promo code on anything before you complete your purchase.

If the promo code has expired, you won’t be able use it.

We’re afraid we can’t accept any responsibility once we have given you a promo code and we are not obliged to provide you with a replacement if it gets lost and/or gets used by someone else as this will result in the promo code being cancelled.

If a promo code is offered on the CoolKitchen Website and can’t run properly because of fraud, tampering, technical errors or anything else that is beyond our control which affects the running, administration, security or fairness of the promo code, we reserve the right to cancel, modify or suspend the promo code.

Promo codes are non-transferable and cannot be exchanged for cash. If you receive a promo code, it can only be used by you on your own CoolKitchen account for the purpose for which it was issued. You must keep it confidential and only use it for making your own orders on CoolKitchen. Don’t pass your code directly on to others or make it available to others (for example, posting it on social media or on a forum). If we believe that at the point of purchase or retrospectively you are abusing the use of promo codes in any way (for example, selling them to others), we reserve the right to cancel your promo code or suspend/close your CoolKitchen account without letting you know beforehand.

We reserve the right to amend these terms and conditions at any time.

The right to withdraw from purchase, return of goods

All deliveries must be signed for and any damages, wrong deliveries and shortages notified to us in writing at our contact address within 24 hours of receipt of delivery. It is essential all packaging is retained in these circumstances otherwise this will negate any action we can take to remedy the situation.

Any items not received must be advised in writing at our contact address within 14 days of the dispatch confirmation e-mail in order that this can be investigated. We will not be responsible for any non delivered items after this time or failure to advise us accordingly.

Someone must be available to sign for the goods during normal working hours and this person should be known to you. We will not be responsible where the person signing for the goods is not the person who has placed the order/paid for the goods or the incorrect address details have been supplied.

If you notify a problem to us under this condition, our only obligation will be, at your option:

To make good any shortage or non-delivery;
To replace or repair any goods that are damaged or defective;
To refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

The purchasers are responsible for all their country’s local/national taxes due and any costs incurred pre-delivery. They should contact their local tax office to ensure they are happy with any taxes they may incur as Coolkitchen.eu will not be responsible for any tax charged or cost incurred or in the event of goods being returned due to non payment of tax. In such circumstances customers are responsible for any costs coolkitchen.eu incurs.

You can return goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange providing the goods are received by us in an unused, undamaged and saleable condition. The costs of returning goods to us shall be borne by you.

We recommend returning the goods by registered/insured post. We will not be liable for any loss or damage incurred whilst returns are held by third parties.

Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required, less (if for any reason these costs have not been paid by you) the costs of delivery to us.

We will not be accountable for any currency fluctuations between the time of purchase and the refund date.

The rights to return the goods to us will not apply in the following circumstances:

in the event that the product has been used or damaged
to any products that we have ordered specifically for you (i.e. that are not held in stock – stated as being available in x number of days on the product’s page), unless it is proven that there is a fault with the product.

In the unlikely event that our customer care team are unable to resolve your complaint, and you are still not satisfied following the conclusion of our complaints handling procedure, then you lodge your complaint on the EU Online Dispute Resolution platform which is available at www.ec.europa.eu/consumers/odr.

Damaged items

Damaged or missing items (i.e. not enclosed within the delivery) must be notified to us within 24 hours of receipt by e-mail. All original packaging MUST BE KEPT for inspection and photographs may be required. We will respond and advise what course of action must be taken in these circumstances.

Linkinking to this website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Severance

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing law and jurisdiction

These terms and conditions are to be construed in accordance with the laws of Slovenia and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Slovenian courts.

Entire agreement

The above Terms and conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and CoolKitchen. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of CoolKitchen.
